Several Democrats in the House have indicated that they will not recognize Donald Trump’s victory in the 2024 election. They base this on the argument that Donald Trump is an insurrectionist and cannot be in office, according to the 14th Amendment.
Democrats who declined to indicate that they would support Trump’s appointment to office in the event that he won the 2024 election included Representatives Jamie Raskin (MD), Adam Schiff (CA), James Clyburn (SC), Eric Swalwell (CA), and even Hakeem Jefferies, the House Minority Leader.
If Democrats take over the House, they may have enough votes to support a challenge to a Trump victory, as Dan McLaughlin of the National Review argued. He stated, “They don’t vote by states, like when the House picks a president under the Twelfth Amendment; only a simple majority is necessary.” “Unlike when they were in the minority in 2016 or 2004, House Democrats might be using live ammo.”
However, a majority of senators would also need to disagree if Trump were to win. It would probably need 51 senators to do this, and as McLaughlin noted, Democrats would have a difficult road ahead of them: He said, “They have to either take a Republican-held seat (the best of which are either Ted Cruz’s in the state of Texas or Rick Scott’s in Florida) or hold every seat they presently have (good luck in West Virginia).”
The Supreme Court, which heard arguments in Trump v. Anderson earlier this month, might provide some order out of this mayhem. The issue concerns whether Colorado, the home state of Trump, has the right under the 14th Amendment to keep him off the ballot. Democrats wouldn’t have a valid objection if the Supreme Court clarified Trump’s eligibility, clearly saying that he is qualified.
Thus far, the arguments seem to be in favor of Trump. Almost all of the justices, even the more liberal ones, appeared quite uncomfortable supporting Colorado on the grounds that Section 3 of the 14th Amendment applied. Interestingly, the purpose of enacting the clause right after the Civil War was to prevent anybody involved in an “insurrection” from holding public office.
Trump’s legal representative, Jonathan Mitchell, said that Section 3 refers to an “officer of the United States,” not the “president,” and that this term encompasses appointed rather than elected authorities. Another argument focused on Colorado classifying Trump as an insurrectionist and then actually disqualifying him before the election, adding a qualifier to him.
The most forceful opposition to Colorado’s assertions came from Judge Elena Kagan. She challenged the Colorado legal team, asking, “Why should a single state be able to make this choice not just for their own residents but also for the nation?” ” It seems quite nationalistic to me. If you weren’t from Colorado and were instead from Wisconsin or Michigan, would what the secretary of state of Michigan did affect the likelihood that Candidate A wins the election rather than Candidate B? That seems rather remarkable, to be honest.
By their own definition this makes them Insurrectionists. Lock them up.
