The Democratic-appointed Colorado Supreme Court justices decided 4–3 in December that former President Donald Trump was not allowed to run for president and could not be on the state’s ballot because he participated in an uprising on January 6. Following the Republican frontrunner’s disqualification in Maine and Illinois in the months that followed, Trump’s legal team filed appeals.
One day before the Republican primaries in Maine and Colorado, the U.S. Supreme Court delivered a well-timed ruling on Monday morning, stating that “we reverse because the Constitution renders Congress, rather than the States, responsible for enforcing Section 3 against federal officeholders and candidates.”
This ruling will definitely affect activist organizations’ attempts in other states to deny their fellow citizens the right to vote and prevent President Joe Biden from running against his main opponent in the next election.
In September 2023, a group of six petitioners supported by Democrats filed a lawsuit to have Trump removed from the Colorado ballots. On behalf of the Colorado voters, Citizens for Responsibility and Ethics in Washington filed the lawsuit.
David Brock, the creator of Media Matters, optimized CREW, a partisan activist organization that positions itself as a government watchdog, as an attack dog for the Democratic Party before the 2016 election. The current president of CREW, Noah Bookbinder, who was a member of the Homeland Security Advisory Council of the Biden Department of Homeland Security until recently, oversaw the implementation of the Colorado program.
The petitioners contend that Trump, as president, is subject to the provisions of Section 3 of the 14th Amendment, which deals with insurrection, and that Trump’s acts on January 6, 2021, qualified.
The state court’s majority said it “did not reach these judgments lightly,” concluding that Trump had “engaged in” rebellion, that the president is subject to Section 3, and that the First Amendment did not apply to Trump’s address at the Ellipse on January 6.
In its decision on Monday, the U.S. Supreme Court appears to concur with Trump’s attorneys over this last point.
