This week, the House of Representatives decided to find Attorney General Merrick Garland in contempt of Congress for his defiance of congressional subpoenas.
After a day of discussion, the vote passed with ease, 216 to 207, considering the slim majority held by House Republicans.
On February 27, 2024, Garland received subpoenas from the House Committees on Oversight and Accountability and the Judiciary seeking documents pertaining to Special Counsel Robert Hur’s probe into President Joe Biden’s deliberate misuse of confidential material.
Republicans were primarily interested in the audio recordings of Hur’s interview with Biden. Republicans criticized Garland’s written transcripts, claiming they were insufficient after Hur disclosed that Biden had a “bad memory” and moments of mental instability throughout the interview.
The head of the Republican Study Committee, Rep. Kevin Hern (R-OK), declared in a statement that “the attorney general is not exempt from Congressional inspection.” The White House has acknowledged the modification of these transcripts from the special counsel’s interview with Biden, a practice they have long used to conceal his embarrassing moments on stage.
“We require the original material, and the DOJ is in contempt of Congress if they disregard the subpoena.”
The Biden DOJ claimed in a report that Garland would not face contempt of Congress charges because Biden had invoked executive privilege over the recordings on the same day as the House vote.
On May 16, 2024, before the Oversight and Judiciary Committees were about to write up their resolutions of contempt, Biden claimed executive privilege over the recordings.
Rep. Dave Joyce (R-OH), a Republican, disagreed with the idea of holding Garland in contempt.
Joyce released a statement saying, “As a former prosecutor, I cannot in good conscience support a resolution that will further politicize our justice system to win political points.” “The American people want Congress to prioritize beneficial governance, work for them, and resolve policy issues. It’s enough.
In contrast, Jim Jordan (R-OH), the chairman of the Judiciary Committee, stated in a thorough article on X that “it is up to Congress, not the Executive Branch, to choose what materials it needs to conduct its own investigations.”
Jordan went on, “The Executive Branch’s press distribution of the interview transcript waived any claim of executive privilege.”
The House vote takes place while Steve Bannon, a former ally of President Donald Trump, is contesting a judge’s decision requiring him to surrender to prison by July 1 in order to fulfill his four-month term for ignoring a subpoena from the now-dissolved January 6 committee of former Speaker Nancy Pelosi (D-CA).

Dems don’t GAF about Congress holding any of them in contempt, which rarely carries any weight aside from optics. If they manage to arrest Garland, he’ll just fall on his sword and be richly rewarded later by the Left, maybe Dean of a law school, etc. The best way to damage Biden, which is the real purpose of all this, is for Trump to point it out in the upcoming debate. When Biden calls him a convicted felon, Trump can point out what a rigged, reversible trial it was, then remind voters that Biden wasn’t indicted because his own DOJ’s investigator considered him mentally unfit to stand trial. He can also bring up the fact that this is a new version of Hidin’ Biden.
