Democrats suffered a major blow to stopping former President Donald Trump’s MAGA movement when U.S. Supreme Court Chief Justice John Roberts declined to oversee the impeachment farce.
Now that Trump has re-entered private life, no constitutional basis exists to warrant a second round of political hi-jinx. Washington, D.C, insiders anticipate that even if Senate Majority Leader Chuck Schumer can coax someone into presiding, the chances of a conviction range between slim and none. Democrats need 17 Republicans to join them. Upwards of 200 GOP members of the House of Representatives opposed the articles of impeachment.
“For the victorious Democrats to seek revenge against Donald Trump would set a terrible precedent, distract from President Biden’s agenda, and make it hard to heal the country. Better to move on,” constitutional scholar and former Harvard Law School Professor Alan Dershowitz recently wrote.
Dershowitz, who successfully defended President Trump during the first impeachment hoax, recently penned a piece for the Wall Street Journal called, “No, You Can’t Try an Impeached Former President.”
“Constitution is clear: ‘The president . . . shall be removed from office on impeachment . . . and conviction’—not by the expiration of his term before the impeachment process is complete. It also mandates that ‘judgment in cases of impeachment shall not extend further than to removal and disqualification’ —not or disqualification,” Dershowitz writes.
The former law professor and celebrated attorney appears spot on in his analysis. According to back-channel reports, Chief Justice Roberts’s decision also appears to be grounded in the U.S. Constitution. The founding document clearly states that “When the President of the United States is tried, the Chief Justice shall preside.” The problem is that the current POTUS is not being tried. Mr. Trump has transitioned into private life.
But Democrats are hoping to throw up another Hail Mary in hopes of persuading enough Republicans to vote guilty and impose a lifetime ban on holding public office. Democrats still suffering from Trump Derangement Syndrome are not even pretending this is anything less than payback. California Rep. Eric Swalwell — who was humiliated after falling prey to seductive Chinese spy Christine Fang, aka “Fang Fang” — went on the record stating Democrats want to “put as one of the penalties disqualification from office … because Donald Trump we know will do this again.”
To say Democrats have run off the rails would be something of an understatement. Left-wing party leaders recently floated the notion they will select one of their own to preside. Damning any semblance of impartiality or credibility, Vermont Sen. Patrick Leahy recently volunteered.
“The president pro tempore has historically presided over Senate impeachment trials of non-presidents,” Sen. Leahy reportedly confirmed. “When I preside over the impeachment trial of former President Donald Trump, I will not waver from my constitutional and sworn obligations to administer the trial with fairness, in accordance with the Constitution and the laws.”
Talk about judge, jury, and executioner. Everyday Americans can anticipate the impeachment sequel to flop worse than the original.
