The California state senate is debating legislation that would empower judges to use criminal punishment to “rectify racial bias” throughout the criminal justice system.
The AB 852 measure, which was approved by the State Assembly in May, is presently making its way through the State Senate’s committee procedure. Although it acknowledges that offenders may already contest their sentences on the grounds of racial injustice, it would also add that judges may take race into account when passing judgment.
State Representative Reggie Jones-Sawyer (D-South LA) presented the measure in February. It is meant to be a component of the “reparations” package that was recently put out to the legislature by a state commission.
It states:
SECTION 1. The Penal Code is amended to add Section 17.3, as follows:
17.3. (a) The California Task Force will examine and Prepare Reparation Plans for African Americans’ findings that racial injustice has historically penetrated our criminal justice system are what the Legislature intends to address.
(b) A Judge sitting over a criminal case shall take into account its disparate effect on historically disadvantaged and system-impacted communities whenever the court possesses discretion in establishing a suitable punishment in accordance with pertinent statutes as well as the Judicial Council’s sentencing guidelines.
It is uncertain if the law complies with the Equal Protection Clause of the U.S. Constitution or with the state constitution of the state of California, which prohibits the state from considering race as a factor in affirmative action.
The statute is also ambiguous as to whether permitting judges to “rectify racial bias” would enable them to give white and Asian defendants harsher punishments than black and Latino defendants.
California is already experiencing an increase in crime, which is partially attributable to district attorneys who are reform-minded and who get funding from far-left billionaire political contributor George Soros.

The Dems do not care about justice or even social justice. They are just trying to secure the votes of minority groups by bribing them with phony reparations. It is just like excusing their college debts. They do not care whether the students get a nice job or not. It is just a matter of securing their votes in elections. but the money they expend on these giveaways come from taxpayes, and they are not free gifts. They are money transfers, and social justice does not justify taking the money to pay them from innocent people who worked hard to earn the money.

It’s sad to see discrimination against anyone. As a 69 year old white male I have avoided any employer, especially government, who practiced affirmative actiion. I preferred employment where I negotiated my own salary based on skill and intelligence. The constitution calls for equal opportunity, not equal outcomes. That is left up to the individual, not the government to stick their bias left wing corrupt policies into.
