An order from a lower court prohibiting important officials of the Biden administration from lobbying social media firms to ban Americans has been temporarily overturned by a federal appeals court.
The panel of three judges for the United States Court of Appeals for the Fifth Circuit, consisting of Carl E. Stewart, who was appointed by Clinton, James E. Graves, who was appointed by Obama, and Andrew S. Oldham, who was appointed by Trump, approved the Justice Department’s petition for a temporary stay.
Because of the suspension, representatives of the Biden administration may now get back in touch with social media businesses. An order issued to the plaintiffs in Missouri versus Biden by the United States District Judge Terry Doughty of Louisiana at the beginning of this month forbade them from doing so.
In accordance with Judge Doughty’s decision, government representatives cannot get in touch with social networking sites “for the purpose of urging, encouraging, pressuring, or causing in any way the removal, elimination, silencing, or lessening of content that contained protected free speech postings.”
Alejandro Mayorkas, the secretary of homeland security, Xavier Becerra, the secretary of health and human services, Vivek Murthy, the surgeon general, Karine Jean-Pierre, the press secretary for the White House, Jen Easterly, the director of the Cybersecurity and Infrastructure Security Agency (CISA), and other federal agencies were all included in the injunction.
Legal counsel for the government claimed that the injunction could stop the government from “engaging in a broad spectrum of lawful and responsible behavior, including speaking on issues of interest to the public and collaborating with social media firms on initiatives that would avoid serious harm to the American people as well as our own democratic processes.”
The interruption is merely momentary and lasts “until further orders of the court.” The Louisiana court’s ruling is being appealed by the administration. The three-judge bench granted the stay and accelerated the government’s appeal in addition to approving the suspension. The earlier decision can be upheld if the government is unsuccessful in its appeal or if the case is heard by a higher court.
Missouri v. Biden, a well-followed lawsuit, has shown the scope of the federal government’s attempts to sway the content filtering choices made by significant digital businesses. The lawsuit’s disclosures have demonstrated that government officials even wanted technology firms to ban private messaging services like WhatsApp, which is owned by Facebook.
The case in question is Missouri versus Biden, No. 3:22-cv-01213-TAD-KDM, filed in the Western District of Louisiana.
The problem wiht your hatchet job is that even the government has to submit to legal review of its actions in most if not all cases. You did not react this way when Trump was scrapping virtually all of the consumer protection laws put to work after the mortgage-bank scandals in 2008 and later, did you, and the hundreds of bilions handed out to major corporations called “bailouts.”
