According to a new study, more than 7 out of 10 criminal defendants who are released from jail without bail were later caught for allegedly committing additional crimes.
During the Chinese coronavirus outbreak in early 2020, the California Judicial Council forced counties to implement an “emergency bail schedule,” which essentially freed thousands of criminal defendants from jail without having to pay bonds in the name of decreasing prison congestion.
“This program mandated that bail for certain offences be drastically lowered, often to zero dollars,” county authorities explain.
Yolo County, CA, in particular, maintained the $0 bail regime until June 2021, when the Superior Court adopted a new bail schedule.
The Yolo County DA’s Office discovered that more than 70% of individuals released without bail were arrested for new crimes after studying release and arrest statistics during the period when the $0 bail policy was in effect.
The study also analyzed recidivism rates through an 18-month period, discovering that 78% of suspects released without bond were rearrested for crimes, while just 46% of those who paid bail were later rearrested.
“The results of this new analysis on the actual impacts of zero bail policy initiatives clearly show that when bail is removed as a tool for use by the courts, victimization greatly increases, and public safety is significantly affected,” Yolo District Attorney Jeff Reisig said in a statement.
During Yolo County’s $0 bail policy, over 600 criminals were released from jail without bond. 420 of the individuals were later re-arrested for different offences, including 369 misdemeanor and 328 felony counts.
“A 163% rise in total crime and a 200% spike in violent crime among arrestees released on zero bail as compared to those freed by the courts on regular bail,” Reisig stated.
Several of the individuals who were released on bond were later arrested for violent crimes such as homicide, rape, abduction, robbery, carjacking, attempted homicide, assault with a dangerous weapon, and domestic abuse.
The report serves as a wake-up call for states like New York, whose cashless bail regulations restrict judges from keeping many defendants in jail while they await trial.
Similarly, in Illinois, a statewide statute abolishing bail that was approved by Democrats is presently being challenged in court. Opponents of the bill have said that it would turn the state into “The Purge,” a reference to the horror film in which residents are permitted to commit crimes without penalty for a whole 24 hours.
